Welcome to Style & Repeat. These Terms and Conditions (the “Terms”) govern your access to and use of StyleRepeatResale.com and any related services, features, content, and purchases (collectively, the “Website”).
The Website is owned and operated by Style & Repeat, a Canadian pre-loved and resale clothing business (“Style & Repeat,” “we,” “us,” or “our”).
Please read these Terms carefully before using the Website. By accessing the Website, creating an account, or placing an order, you agree to be bound by these Terms and by our Privacy Policy, Shipping Policy, and Return and Refund Policy. If you do not agree, do not use the Website.
Nothing in these Terms limits any right or remedy that cannot legally be waived under applicable consumer-protection law.
1. Eligibility and Adult-Only Use
The Website and our products are intended only for adults aged 18 or older. By using the Website or placing an order, you confirm that you are at least 18 years old and legally capable of entering into a binding contract.
Anyone under 18 must not create an account, place an order, join our mailing list, submit personal information, or use interactive features of the Website.
2. Pre-Loved and Resale Items
Style & Repeat sells pre-loved, vintage, and previously owned clothing, footwear, handbags, jewellery, and accessories unless a listing clearly states that an item is new.
Pre-loved items may show natural signs of age, handling, storage, alteration, repair, or previous wear. These characteristics may include fading, creasing, pilling, scratches, hardware wear, minor marks, fabric variation, missing original packaging, or other imperfections.
We make reasonable efforts to photograph and describe each item accurately, including any material wear or imperfections we identify. However, photographs form an important part of every description. Before purchasing, you are responsible for:
- reviewing all photographs;
- reading the complete description and condition information;
- checking the listed measurements rather than relying solely on a garment’s size label; and
- contacting us before purchasing if you require additional information, measurements, or photographs.
Minor variations in colour may occur because of photography, lighting, or screen settings and are not necessarily defects. Vintage and designer sizing may also differ from modern sizing standards.
3. Designer Names, Trademarks, and Authenticity
Brand names, logos, and trademarks appearing on the Website belong to their respective owners and are used only to identify and describe genuine branded resale items. Style & Repeat is an independent resale business and is not affiliated with, sponsored by, endorsed by, or an authorized retailer of any designer or brand unless expressly stated.
We assess items and describe them based on the information and indicators reasonably available to us. Any authentication service, certificate, serial number, date code, receipt, dust bag, box, or other supporting material included with an item will be identified in the listing. Customers should not assume that an accessory or authentication document is included unless it is specifically shown or stated.
If you believe an item received is materially different from its listing, contact us promptly in accordance with our Return and Refund Policy.
4. Product Availability
Most items are one of a kind and may be offered through more than one sales channel. Placing an item in your cart does not reserve it. An item may remain available to other customers until payment is completed and the order is accepted.
Occasionally, an item may sell elsewhere, become unavailable, or contain an inventory or listing error before our system updates. If we cannot fulfil your order, we will cancel the affected item and refund the amount paid for it.
We may limit purchase quantities or discontinue any product at any time.
5. Prices, Currency, Taxes, and Charges
Prices are shown in the currency displayed on the Website. Unless another currency is clearly identified, prices are in Canadian dollars (CAD).
Applicable taxes, shipping charges, and any other required charges will be shown at checkout before you submit your order. Prices and availability may change without notice, but a price change will not affect an order we have already accepted.
For international orders, the customer is responsible for customs duties, import taxes, brokerage charges, and other fees imposed by the destination country unless checkout clearly states that those charges are included. Currency-conversion rates and foreign transaction fees are determined by your payment provider and are not controlled by Style & Repeat.
We may correct typographical, pricing, or calculation errors. If an error affects an order you have placed, we will contact you or cancel the affected item and issue a refund. We will not substitute a different price or product without your agreement.
6. Orders and Contract Formation
Submitting an order is an offer to purchase the items in your cart. An automated order confirmation acknowledges receipt of your order but does not necessarily mean that we have accepted it.
An order is accepted when we confirm shipment or otherwise expressly confirm acceptance. We may refuse or cancel an order before acceptance for reasons including:
- an item being unavailable;
- a pricing, description, inventory, or technical error;
- payment authorization failure;
- suspected fraud, unauthorized activity, or misuse;
- an incomplete or invalid shipping address;
- restrictions affecting the destination; or
- a violation of these Terms.
If we cancel an order after payment has been collected, we will refund the amount charged for the cancelled item. We may contact you to verify an order before accepting it.
7. Payment
You agree to provide complete and accurate billing, payment, contact, and shipping information. You confirm that you are authorized to use the payment method submitted with your order.
Payments are handled by third-party payment providers. Style & Repeat generally does not receive or store your complete credit-card number or security code. Your use of a payment method may also be governed by the payment provider’s terms.
We may delay or cancel an order if payment cannot be authorized or if additional verification is reasonably required.
8. Shipping and Delivery
Orders are generally processed and shipped within 1–3 business days after the order and payment are received. Shipping charges for Canadian and international orders are calculated at checkout.
Most packages are estimated to arrive within 5–15 business days after shipment, but delivery dates are estimates and are not guaranteed. Weather, holidays, customs, carrier disruptions, and other circumstances outside our reasonable control may cause delays.
You are responsible for providing a complete and accurate delivery address. Risk relating to a shipment will be handled in accordance with applicable law and our Shipping Policy.
Our Shipping Policy is incorporated into these Terms and provides additional information about tracking, customs, address errors, delayed packages, and damaged shipments.
9. Returns, Refunds, and Cancellations
Because Style & Repeat sells unique pre-loved items, all sales are generally final. We do not accept returns or provide refunds for change of mind, fit, incorrect size selection, minor colour variation, or wear and condition details that were shown or disclosed in the listing.
Limited exceptions may apply if you receive the wrong item, the item is damaged during shipping, or the item is materially different from its photographs or written description. You must contact us within the time and in the manner stated in our Return and Refund Policy.
Do not return an item without written authorization. Our Return and Refund Policy is incorporated into these Terms. If there is a conflict concerning a return or refund, the more specific provisions of the Return and Refund Policy apply, subject always to applicable law.
10. Accounts and Account Security
If the Website allows customer accounts, you are responsible for providing accurate information, protecting your login credentials, and all activity performed through your account.
Notify us promptly if you suspect unauthorized access. We may suspend or close an account if we reasonably believe it is being misused, presents a security risk, or violates these Terms.
You may not impersonate another person, create an account using false information, or use another person’s account or payment information without authorization.
11. Acceptable Use
You must not use the Website to:
- break any law or infringe another person’s rights;
- commit or attempt fraud, chargeback abuse, payment misuse, or identity theft;
- interfere with the Website’s security, operation, or availability;
- introduce malware, harmful code, bots, scrapers, or automated requests without permission;
- collect information about other users;
- copy, reproduce, republish, sell, or exploit Website content without written permission;
- submit false, defamatory, threatening, abusive, discriminatory, obscene, or unlawful material; or
- misrepresent your identity, affiliation, age, delivery address, or payment authority.
We may restrict access, cancel orders, or take other reasonable action if these Terms are violated.
12. Reviews, Messages, and Other Submitted Content
If you submit a review, photograph, comment, testimonial, suggestion, or other content to Style & Repeat, you confirm that you own it or have permission to submit it and that it is accurate and lawful.
You retain ownership of your content, but you grant Style & Repeat a non-exclusive, worldwide, royalty-free licence to use, reproduce, display, adapt, and share that content for operating and promoting the business, subject to our Privacy Policy and applicable law. We will not use a customer’s private message as a public testimonial without permission where consent is required.
We may decline or remove submitted content that is unlawful, irrelevant, misleading, abusive, infringing, or otherwise inappropriate. We are not required to publish every review or submission.
13. Intellectual Property
Except for third-party brand names and materials, the Website and its content—including the Style & Repeat name, original photographs, graphics, logos, text, layout, and design—are owned by or licensed to Style & Repeat and are protected by applicable intellectual-property laws.
You may use the Website only for personal, non-commercial shopping purposes. No content may be copied, modified, distributed, displayed, republished, or used commercially without prior written permission, except as permitted by law.
14. Privacy and Electronic Communications
Our collection, use, disclosure, retention, and protection of personal information are described in our Privacy Policy, which is incorporated into these Terms.
By placing an order, you agree to receive transactional messages required to process and service it. Promotional emails will be sent only as permitted by applicable law, and you may unsubscribe using the link provided in the message.
15. Third-Party Services and Links
The Website may rely on or link to third-party services, including payment processors, shipping carriers, social-media platforms, analytics providers, and external websites. We do not control third-party services and are not responsible for their independent content, availability, security, or privacy practices.
Your use of third-party services may be governed by their own terms and policies.
16. Website Availability and Disclaimer
We try to keep the Website accurate, secure, and available, but we cannot guarantee that access will always be uninterrupted, timely, error-free, or free from harmful components. We may modify, suspend, or discontinue any Website feature for maintenance, security, operational, or business reasons.
To the fullest extent permitted by law, the Website is provided on an “as available” basis. Any conditions, warranties, or guarantees that cannot legally be excluded remain in effect.
17. Limitation of Liability
To the fullest extent permitted by law, Style & Repeat will not be liable for indirect, incidental, special, consequential, or punitive losses arising from your use of the Website or purchase of an item, including lost profits, lost opportunities, or loss of data.
Where liability cannot legally be excluded, our total liability relating to a particular order will not exceed the amount you paid for the item giving rise to the claim, except where a different remedy is required by law.
These limitations do not apply to liability that cannot legally be limited or excluded, including liability arising from fraud, wilful misconduct, or any other matter protected by mandatory law.
18. Indemnity
To the extent permitted by law, you agree to be responsible for reasonable losses, claims, and costs incurred by Style & Repeat as a direct result of your unlawful conduct, fraud, misuse of the Website, infringement of another person’s rights, or material breach of these Terms.
This section does not require you to indemnify Style & Repeat for our own negligence, misconduct, or breach of law.
19. Governing Law and Disputes
These Terms are governed by the laws of the Province of Nova Scotia and the federal laws of Canada applicable there, without regard to conflict-of-law rules.
Before starting formal proceedings, you and Style & Repeat agree to make a reasonable effort to resolve the concern by contacting one another in writing. If a dispute cannot be resolved informally, the courts of Nova Scotia will have jurisdiction, unless applicable consumer law entitles you to bring a claim in another jurisdiction or prohibits this provision.
20. Changes to These Terms
We may update these Terms to reflect changes to the Website, our business practices, or legal requirements. The revised Terms will be posted with a new “Last updated” date.
Changes apply from the date they are posted and do not retroactively change an order already accepted unless required by law or agreed with you. Your continued use of the Website after revised Terms take effect means you accept the updated Terms.
21. General Provisions
If any provision of these Terms is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect.
Our failure to enforce a provision does not waive our right to enforce it later. You may not transfer your rights or obligations under these Terms without our written permission. We may transfer these Terms in connection with a sale, reorganization, or transfer of our business, subject to applicable law.
These Terms, together with the policies incorporated into them and the details confirmed in your order, form the entire agreement between you and Style & Repeat regarding your use of the Website and purchase.
